If you create new namespace in the same SWCV then there may be chance of loosing it if you update the ESR content as it is standard.
If possible i would suggest you to copy into another SWCV so that there won't be FOL 
on a side note, may be someone might have manually edited the action? Also can you check whether your action is internal in other landscape. i see that the selection criteria only shows external when you try inserting an action and which makes sense.
